Rita,

 

Per the agreements with Hopkins, he has broad consultation rights on our release pattern and advertising campaign for the initial U.S. and U.K. theatrical release of the picture.  This is not tied to whether we use his likeness in the campaign.  See Section 1 below.

 

In addition, he has a likeness tie to any other cast member and his likeness cannot be used in any commercial tie-up with out his prior written approval.  See Section 5 below.

 

Section 1.  Advertising Consultation, Restrictions and/or Requirements:

 

“Producer shall fully and meaningfully consult with Artist or Artist’s designee (i.e. publicist) with respect to Producer’s plans in connection with the release pattern and advertising campaign (including the one/sheet and key art and any “standees” or other 3D display material) for the initial U.S. and U.K. theatrical release of the Picture.”

 

Section 5.  Likeness Requirements/Restrictions:

 

“If the likeness of any other cast member appears in any paid ad (other than award, nomination or congratulatory ads depicting solely the honoree) Artist’s likeness shall also appear in paid ad and shall be used in such a manner as to appear equal in size to the likeness of such other cast member(s)”

 

And

 

“Notwithstanding the foregoing, neither Artist’s name nor likeness may be used in any commercial tie-up without Lender’s prior written consent, nor may Artist be shown or depicted as endorsing any product or service other than the Picture.”

Based on what I’m reading, Anthony Hopkins has consultation in regard to artwork for the film.  It does not stipulate it must contain the use of his likeness.  Is this correct?  Or, shall I presume that it pertains to only if we use his likeness.  Please confirm.
